SHAISTA QAISER VS ALTAF AHMAD KHAN. S.420---Cheating---Re-appraisal of evidence---Acquittal of accused. Complainant alleged that accused, her former husband, prepared a false Nikahnama showing her different name to obtain benefits from his employer organization. Trial Court and High Court acquitted accused. Held: Original Nikahnama was produced by complainant herself which showed that the matter was within her knowledge from the beginning. Nikahnama was never sent for forensic examination or handwriting expert opinion. No official witness from employer organization was produced to verify alleged benefits obtained through fake Nikahnama. To prove cheating, prosecution must establish dishonest inducement, delivery of property or valuable security, alteration of valuable document and resulting harm or injury. Acquittal is not merely a verdict of not guilty but an affirmation that State failed to discharge burden of proof. Supreme Court declined interference as there was no illegality, irregularity or perversity. Petition for leave to appeal was dismissed.
