SAID-UR-REHMAN VS State. Ss.302(b), 201 & 34---Cr.P.C. Ss.164 & 364---Confessional statement. Reappraisal of evidence---Benefit of doubt---Discrepancies in recording judicial confession. Accused were arrested on 17.02.2016 during purported inquiry before registration of FIR. Judicial confessions were recorded on 23.02.2016 after six days of illegal arrest. Statements of Magistrate and Investigating Officer regarding custody of accused after recording confession were contradictory. Such inconsistency created doubt regarding voluntariness and reliability of alleged confessions. Prosecution failed to prove case beyond reasonable doubt. Appeal against conviction was allowed.
