RIAZ (deceased) VS GULZAR. S.302(b)---Qatl-i-amd---Qanun-e-Shahadat (10 of 1984), Art.46---Reappraisal of evidence---Dying declaration, recording of. Deceased was in a fit state of health to make dying declaration. Medical Officer examined the deceased and found him fully conscious and oriented in time and place. Medical evidence showed that deceased sustained multiple firearm injuries. Medical Officer stated that he asked questions from deceased before examination and deceased responded clearly. Comparison of dying declaration and statement of eye-witness showed that both statements were consistent on material points. Failure of recorder to obtain attestation of Medical Officer on dying declaration was only a procedural lapse and could not be used in favour of accused when evidence established that deceased was conscious and capable of making statement. Petitions were dismissed and leave was declined.
