RIAZ (deceased) VS GULZAR. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Non-recovery of some crime empties from the scene---Inconsequential. Accused was charged for committing murder by firing. Recovery of blood-stained earth and one crime empty of .30 bore pistol confirmed the place of occurrence. Non-recovery of remaining crime empties was not fatal because occurrence took place near a railway track and mosque where people gathered after occurrence and remaining empties could have been misplaced. Petitions were dismissed and leave was declined.
