Muhammad Hussain VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Consequential---Delay of seven hours and fifteen minutes in conducting the postmortem examination upon the dead body of the deceased---Accused was charged for committing murder of the niece of the complainant by firing---Though the FIR was promptly lodged i.e. within 45 minutes of the occurrence but according to statement of Woman Medical Officer, she conducted autopsy on the dead body of the deceased on 05.07.2021 at 03:15 p.m.---According to Female Medical Officer, the dead body of the deceased was brought by Lady Constable at 11:05 a.m., but postmortem examination was conducted on the same day at 03:15 p.m.---Thus there was delay of seven hours and fifteen minutes in conducting the post mortem examination on the dead body of deceased---Prosecution had not brought any iota of evidence to justify the inordinate delay in postmortem examination of the deceased---In such eventuality the most natural inference would be that the delay so caused was for preliminary investigation and prior consultation to nominate the accused and plant eye-witnesses of the occurrence---Appeal against conviction was allowed, in circumstances.
