Ismail Khan alias Razi Gul VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Absconsion of accused---Scope---Accused was charged for committing murder of the brother of complainant and his friend by firing---Record showed that the appellant remained absconder for more than 01 year and finally he was arrested from another Province and his action as fugitive from law was another circumstance where an inference had to be drawn under Art. 129(g) of the Qanun-e-Shahadat, 1984 that he intentionally hid himself in another Province to avoid trial and there was no reason to believe that the appellant had no knowledge of murder of his son-in-law and his friend---Circumstances established that the prosecution had proved its case against the accused beyond shadow of doubt, however, due to mitigating circumstances, life imprisonment was reduced to imprisonment for 20-years---With said modification in sentence, the appeal against conviction was dismissed, accordingly.
