Parvaiz VS State Ss. 302(b), 324, 504, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, intentional insult with intent to provoke breach of peace, rioting armed with deadly weapons and unlawful assembly---Appreciation of evidence---Sentence, reduction in---Third eye-witness not examined---Crime weapon not recovered---Investigative defects---Post-mortem not conducted---Mitigating circumstances---Death sentence converted into imprisonment for life---Accused were charged with committing the murder of the wife of the complainant's brother by firing---In the present case, certain mitigating circumstances warranted reduction of sentence from death to imprisonment for life---Third alleged eye-witness was not examined before the Trial Court although, being an alleged eye-witness of the incident, he was an essential and important witness---No crime weapon was recovered from the possession of the appellant or on his pointation---There were certain discrepancies/defects in the investigation of the case, including the fact that the Investigating Officer had not secured bloodstained earth and clothes of the deceased and post-mortem was not conducted---On account of said factors, death sentence was not warranted; rather, sentence of imprisonment for life would meet the ends of justice---Circumstances established that the prosecution had proved its case beyond reasonable doubt; however, due to mitigating circumstances, the death sentence was converted into imprisonment for life---With said modification in sentence, appeal against conviction was dismissed, accordingly.
