Karamat Ali VS State Ss. 302(b), 324, 337-a(i), 337-F(i), 337-F(ii) & 34---Qatl-i-amd, attempt to commit qatl-i-amd, shajjah-i-khafifah, ghayr-jaifah-damiyah, ghayr-jaifah badi'ah, common intention---appreciation of evidence---Identity of accused not proved---accused was charged that he along with his co-accused committed murder of the wife of complainant and caused injuries to the witness---Injured witness clearly stated before the Court that he was having no acquainted with accused prior to the occurrence---Other eye-witness also stated before the Court that he was having no acquaintance with accused prior to the occurrence---If said witnesses were not acquainted with accused, then it was necessary for them to mention features of the assailant in the application for registration of the case as well as their statements during investigation to identify him during identification parade on the basis of features including facial features, which exercise had not been undertaken by the prosecution---appeal against conviction was allowed, in circumstances.
