Karamat Ali VS State Ss. 302(b), 324, 337-a(i), 337-F(i), 337-F(ii) & 34---Qatl-i-amd, attempt to commit qatl-i-amd, shajjah-i-khafifah, ghayr-jaifah-damiyah, ghayr-jaifah badi'ah, common intention---appreciation of evidence---Presence of witnesses at the spot not proved---accused was charged that he along with his co-accused committed murder of the wife of complainant and caused injuries to the witness---Complainant was husband of deceased of the case but he did not intervene for saving his wife although assailants were not equipped with any sophisticated firearm weapon---So much so, even after fleeing away of the assailant from the place of occurrence, if complainant and other cited eye-witnesses managed deceased in injured condition or helped her for boarding in the vehicle of 1122, then their clothes might have been stained with blood but bloodstained clothes of complainant or any other cited eye-witness had not been produced---Complainant made dishonest improvements regarding the locale of injuries sustained by deceased of the case---Injured witness also made dishonest improvements regarding the locale of injuries sustained by him---appeal against conviction was allowed, in circumstances.
