Muhammad Ramzan VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Motive of the occurrence not proved---Accused was charged for committing murder of the father of complainant by inflicting hatchet blows---Complainant in the application for registration of the case had mentioned that dispute over land of father of the complainant was going on with appellant, who, under the pretext of compromise, took the deceased at his land and committed the occurrence---Dispute between the parties was of civil nature and pending before the Member Board of Revenue, since 2019, therefore, it was not afresh litigation/grudge because occurrence took place on 29.06.2021 and neither any quarrel/fight between the parties during their appearance before the Courts took place nor any criminal case was registered earlier in that regard---So on the one hand, said motive was old, feeble and weak whereas on the other hand, immediate cause of occurrence i.e. what happened now which compelled the accused to commit the murder of deceased could not be established---Even otherwise, motive was a double edged weapon, it cuts both the ways, it could also be a reason for false implication---Furthermore, when substantive evidence had been discarded, then motive lost its significance and became immaterial for conviction---Circumstances established that prosecution had failed to prove its case against the appellant beyond shadow of doubt---Appeal against conviction was allowed, accordingly.
