Muhammad Arshad VS State Ss. 302(b), 364, 109, 148 & 149---Qatl-i-amd, kidnapping and abducting a person in order to murder, abetment, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Benefit of doubt---Delay of 08-hours in lodging the FIR---Consequential---Accused were charged for committing murder of the son of complainant after kidnapping him---As per the contents of private complaint, occurrence took place around Fajar time on 12.08.2014 whereas written application was claimed to have been moved at 01:05 pm---In that way, crime alleged to have taken place around Fajar time (04:30 am to 05:30 am), was reported to police with delay of around 08 hours---No explanation whatsoever had been put forward by the prosecution for such inordinate delay---Said fact being so, there could have been no reason for moving of application at 01:05 pm, except preliminary investigation and prior consultation to nominate the accused and plant eye-witnesses of the crime---Appeal against conviction was allowed, in circumstances.
