Abdul Latif VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Ocular account and medical evidence---Contradictions---Accused were charged for committing murder of the nephew of complainant by strangulating him with a rope---All the prosecution witnesses categorically stated during their depositions that neither the clothes of the deceased nor the rope (alleged weapon of offence) bore any bloodstains---Contrarily, the report of the Chemical Examiner explicitly reflected that both the said articles were stained with human blood, thereby creating a material contradiction in the ocular and medical evidence of the prosecution---Appeal against conviction was allowed, in circumstance.
