Muhammad Arshad VS State Ss.302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Medical evidence not supporting prosecution case--- Accused was charged that he along with co-accused committed murder of son of complainant by firing--- Medical Officer found eleven injuries on deceased, out of which seven were firearm entry wounds--- Number of injuries observed by Medical Officer did not support prosecution version regarding roles attributed to accused persons and did not correspond with number of assailants--- Three injuries were attributed to one acquitted accused and one injury was attributed to another acquitted accused, whereas present appellant was assigned only one firearm injury--- When prosecution case had already been disbelieved regarding co-accused who were assigned effective roles, reliance upon medical evidence alone to maintain conviction of appellant was unsafe--- Medical evidence is corroborative in nature and may confirm location and type of injuries, weapon used and time between death and postmortem, but it does not establish identity of assailant--- Appeal against conviction was allowed, in circumstances.
