Muhammad Arshad VS State Ss.302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Motive not proved--- Accused was charged that he along with co-accused committed murder of son of complainant by firing--- Prosecution alleged motive that on 16.02.2019 son of deceased had fired pistol shot at acquitted accused, for which deceased and his son were challaned--- Motive was attributed to accused who had already been acquitted and not to present appellant--- Complainant admitted during cross-examination that appellant had no previous litigation or enmity with complainant party--- Investigating Officer also stated that appellant had no personal enmity with deceased--- Motive being an important circumstance was not proved against appellant and failed to connect him with occurrence--- Appeal against conviction was allowed, in circumstances.
