Tanveer Amjad Tahir VS Shahid Mehmood Ss.2(b), 15, 19 & 22---Constitution of Pakistan, Art.199---Ejectment proceedings---Rejection of leave to contest, challenge to---Dispute regarding arrears/security requiring oral evidence---Effect---Final order, meaning of--- Petitioner was tenant under rent agreement for five years at monthly rent of Rs.13,000/- with 10% annual increase and security amount paid in advance--- Landlord filed ejectment petition under S.19 of Punjab Rented Premises Act, 2009 on grounds of expiry of tenancy and default in payment of rent--- Tenant sought leave to contest and asserted that security amount of Rs.3,75,000/- was agreed to be adjusted towards rent and claimed that Rs.1,95,000/- remained outstanding--- Rent Tribunal refused leave to contest and ordered eviction which was upheld in appeal--- Held: Leave application disclosed sufficient grounds requiring production of oral evidence--- Under S.2(b) of the Act, Rent Tribunal was bound to decide dispute relating to security amount and arrears of rent before conclusion of proceedings--- Rent Tribunal failed to exercise jurisdiction vested in it and order passed could not be treated as final order--- Leave to contest filed by tenant was accepted and constitutional petition was allowed.
