Irshad Ali VS State Ss. 302(b), 376 & 511---Qatl-i-amd, rape, attempted rape---Appreciation of evidence---Call Data Record and recovery of mobile phones---Inconsequential---Accused was charged for committing murder of the sister of complainant after raping her---Another subject of the prosecution case rested on the Call Data Record (CDR) and alleged recovery of mobile phones---However, the prosecution utterly failed to establish the ownership of the SIM card allegedly used by the accused---No documentary evidence was brought on record to prove that the SIM card was registered in the name of the accused or that the recovered mobile handset belonged to him---More importantly, no phone call recordings or transcripts were produced to show the nature of the conversation between the accused and the deceased---Prosecution neither established the context nor the content of any communication between them---Prosecution's reliance on the CDR without corroborative evidence amounted to mere conjecture and suspicion---Appeal against conviction was allowed, in circumstances.
