Haji Khan Notkani VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Delay of seven days in lodging the FIR---Consequential---Accused was charged for committing murder of the brother of complainant---Alleged incident occurred on 04.03.2015 at 05:00 a.m., whereas the FIR was lodged on 10.03.2015, reflecting an unexplained delay of approximately seven (07) days---Prosecution had failed to provide any plausible explanation for the delay in lodging the FIR, which reflected mala fide intention and lack of bona fides on the part of the complainant---Circumstances established that the prosecution failed to prove its case beyond shadow of doubt---Appeal against conviction was allowed, accordingly.
