KASHIF NOUMAN ALIAS KASHI VS STATE Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Contradictions in the statement of witnesses---Accused were charged for committing murder of the brother of complainant---One of the witnesses admitted during cross-examination that even till 08.12.2019 none of the witnesses related to the deceased, including the complainant of the case, had any knowledge about the involvement of the appellants in the qatl-i-amd of the deceased---Such version of the said witness itself was sufficient to reject the statements of the prosecution witnesses that on 30.11.2019, the appellants had confessed to their guilt as it was admitted by the prosecution witness that even till 08.12.2019, neither he nor any of the witnesses related to the deceased, including the complainant of the case, had any knowledge about the involvement of the appellants in the qatl-i-amd of the deceased---Appeal against conviction was allowed, in circumstances.
