KASHIF NOUMAN ALIAS KASHI VS STATE Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Unnatural conduct of the witnesses---Accused were charged for committing murder of the brother of complainant---Conduct of the prosecution witnesses was not natural at all---There was no explanation as to why the arrest of the appellants was not made by the said witnesses after hearing of the alleged extra judicial confession by the appellants reflecting that indeed no such confession was ever made---Another reason to reject the statements of the prosecution witnesses was that on 30.11.2019 at about 07.00 p.m., when both the witnesses were present in the house of one of the witnesses, both the appellants came there and confessed their guilt of having committed the qatl-i-amd of deceased; they never reported the matter of the confession of the appellants on 30.11.2019 to the police and it was only on 07.12.2019 at 05.15 p.m. that one of the witnesses submitted the application to police for the registration of the FIR and in which application the allegation of the appellants having confessed to their guilt on 30.11.2019 was mentioned---However, it had not been explained at all that why the matter of confession of the appellants was not reported immediately---Delay with which the application was submitted by complainant to police on 07.12.2019 was proof of the fact that the delay was used to fashion out and concocted a false narrative against the appellants---Appeal against conviction was allowed, in circumstances.
