Mst. Fateh Khatoon VS Muhammad Qasim Ss. 302(b), 201, 342, 337-H(2), 506(2), 109, 148 & 149---Qatl-i-amd, causing disappearance of evidence of offence or giving false information to screen offenders, wrongful confinement, hurt by rash or negligent act, criminal intimidation, abetment, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Unnatural conduct of witnesses---Accused were charged for committing murder of the nephew of the complainant by firing---Prosecution alleged that the accused persons committed the murder inside a room during the night at about 2:30 a.m. and thereafter confined the complainant party in another room by locking them inside until around 6:00 a.m. the following morning---Further alleged that the complainant party managed to push open the door at that time---However, as per the FIR, it was stated that the door was opened by the accused in the early morning, whereas in her testimony, the complainant deposed that two unknown culprits had confined them in a room---Thereafter, at about 6:00 a.m., the door of the room was opened by them, and when complainant come out, hehad seen that no person from our village was present at the place of wardat---Such conduct, however, appeared wholly unnatural and inconsistent with normal human behavior---Purported eye-witnesses' conduct, as described, was manifestly unnatural---Their failure to intervene, raised an alarm, or attempt to escape during that prolonged period casted serious doubt upon the veracity of their account and the credibility of their alleged presence at the scene of the occurrence---Appeal against conviction was allowed, in circumstances.
