HIGH COURT OF SINDH AT KARACHI EXAMINATION PAPER FOR CIVIL JUDGES & JUDICIAL MAGISTRATES (TEST PAPER-II) Total Marks: 100 Time: 3 hours Note: Subject to the options wherever provided all questions are compulsory. 1. State the procedure provided for recording of a Confessional Statement and of conducting Identification Parade by referring the relevant provision of law? (20 marks) 2. Write notes on any four of the followings: (20 marks) (A) Power of Magistrate conferred under section 167 and 173 Cr.P.C. (B) Any three general defences under the Pakistan Penal Code. (C) How the place of trial of an offence is determined. (D) Define "Arsh", "Diyat" and "Daman". (E) Specify the grounds for cancellation of bail. 3. (A) State as to whether an accused can be convicted on the basis of Confessional Statement of a co-accused. Please refer the relevant provisions of Qanoon-e-Shahadat Order, 1984? (10 marks) (B) Explain in detail different stages of criminal trial, starting from a First Information Report to announcement of Judgment? (10 marks) 4. Attempt any four of the followings:- (20 marks) (A) Define and differentiate between Res-judicata and Res-subjudice by mentioning the relevant sections. (B) When can a plaint be rejected. (C) Facts of which Court must take judicial note. (D) Injunctive reliefs both mandatory and prohibitory. (E) Define and differentiate between void and voidable contracts. 5. Write note on any four of the followings: (20 marks) (A) Burden of proof keeps on shifting. (B) Attachment before and after judgment. (C) Differentiate between Section 47 and Order XXI Rule 58 CPC. (D) Bailment and Pledge. (E) Effect of Arbitration clause in an agreement, subject matter of a suit.
