MUHAMMAD SALEEM SAFDAR VS KHURSHID AHMAD West Pakistan Urban Rent Restriction Ordinance 1959--13 , West Pakistan Urban Rent Restriction Ordinance 1959 ----S. 13---Ejectment of tenant---Relationship of landlord and tenant between parties was denied by tenants who claimed ownership of property in question--Rent Controller ordeied ejectment of petitioners mainly on the ground that rent note had been executed by petitioner's predecessor relating to such property---Petitioners' appeal against ejectment was dismissed---Validity---Petitioners claimed that rent note related to another property of respondent, possession whereof had been delivered to respondent---Question as to whether rent note executed by petitioners' predecessor related to property in question was essentially one of fact---Rent Controller as also Appellate Forum, on thorough appraisal of evidence, had concurrently found that rent note in question was in respect of property from which eviction of petitioners' predecessors was sought by filing ejectment application out of which Constitutional petition had arisen--Order of ejectment of petitioners was maintained in circumstances.
