FATIMA VS MUHAMMAD MUSA 1980 SCMR 29, 1996 SCMR 1773, West Pakistan Urban Rent Restriction Ordinance 1959--13 , West Pakistan Urban Rent Restriction Ordinance 1959--15 , West Pakistan Urban Rent Restriction Ordinance 1959 ----Ss. 13(2) (vi) & 15---Ejectment of tenant on ground of reconstruction and personal requirement---Essentials---Dismissal of landlord's application by Rent Controller---Validity---Any person who desired to file eviction application on ground of personal requirement and reconstruction must be landlord and owner of premises---Sanction granted by Municipal Committee being in the name of original owner, same was not defective, for property still stood in his name--Even if sanction plan was not in the name of actual landlord they were still protected under provision of S.13(5), West Pakistan Urban Rent Restriction Ordinance, 1959---Landlords were, thus, entitled to eviction of tenants on ground of reconstruction of premises.
