AZIZUR REHMAN VS PERVAIZ SHAH West Pakistan Urban Rent Restriction Ordinance 1959--13 , West Pakistan Urban Rent Restriction Ordinance 1959 ----S. 13---Ejectment of tenant on default etc.---Payment of Pagree---Effect on tenancy and maintenance of eviction petition---Tenant's contention was that since he had paid a substantial amount as "Pagree" to the landlord he could not, therefore, maintain ejectment proceedings against him---Validity---Held, payment of "Pagree" not forming terms and conditions of tenancy and being contrary to public policy, any supra-contractual arrangement which negated tenancy could not affect maintainability of eviction proceedings.
