SHAUKAT ALI VS MUHAMMAD AYUB West Pakistan Urban Rent Restriction Ordinance 1959--13 , West Pakistan Urban Rent Restriction Ordinance 1959 ----Ss. 13(6) & 15---Rent Controller's tentative rent order ---Non-compliance--Tenant's defence was struck off for non-compliance of Rent Controller's order of deposit of tentative rent anti his eviction ordered---Order of Rent Controller was affirmed by First Appellate forum---Validity---Tenant had failed to deposit whole of the arrears of rent as per direction of Rent Controller---Tenant initially taking plea that he had lost receipts for payment of rent relating to specific months but at the same time making application and obtaining routine order for deposit of rent relating to period in question---Tenant did all this in a clever and clandestine manner in order to hoodwink the Rent Controller for which he had to suffer---Tenant's defence was, thus, rightly struck off and he was summarily directed to hand over possession of premises in question to landlord---No fault could be found with the orders of Courts below---Orders of Courts below were affirmed by High Court in circumstances.
