HALEEMA BANKER VS GHULAM RASOOL SAMROO Sindh Rented Premises Ordinance 1979--14 , Sindh Rented Premises Ordinance 1979 ----S. 14---Bona fide personal need of landlord---Plea of bona fide personal need lacking bona fides---Effect---Where landlady/landlord was admittedly 60 years of age she/he could be accorded benefit of S. 14, Sindh Rented Premises Ordinance, 1979, which for persons, transcending the ages of 60 years excludes the element of bona fides in matters of personal requirement---Summary procedure for seeking eviction, inter alia, in such like cases is enjoined by S. 14 of the Ordinance, the only exception being that tenancy was not created after the attainment of the age of 60 years---Where relevant material was available in sufficient detail on the record (even if plea of sixty years of age was lacking) parties should not be pushed to fresh round of litigation, but pendente lite developments, could always be resorted to, in order to do complete justice between the parties, thus, opening way for adequate relief.
