MOMIN BAI VS MUHAMMAD ISMAIL 1987 CLC 1134, 1987 CLC 148, 1989 CLC 252, PLD 1986 Kar. 74, Sindh Rented Premises Ordinance 1979--15 , Sindh Rented Premises Ordinance 1979--2 , Sindh Rented Premises Ordinance 1979 ----Ss. 2(f)(j) & 15---Relationship of landlord and tenant---Landlord had purchased premises from its occupant and thereafter lease in respect of that premises was granted by Authority in his favour---Tenant, had himself admitted in cross-examination that he was paying rent to original occupant of premises---Tenant had also admitted in written statement that presently premises had stood leased out in favour of landlord---Tenant's suit to establish his title over premises, was finally dismissed even in appeal---Rent Controller, in circumstances, had rightly found that relationship of landlord and tenant existed between the parties---Tenant did not pay rent to landlord even after institution of eviction application for the reason that he never recognized landlord as such---Tenant was rightly ordered to be evicted on ground of default.
