MUHAMMAD RAFIQUE VS ALLAH NOOR 1980 SCMR 506, West Pakistan Urban Rent Restriction Ordinance 1959--13 , West Pakistan Urban Rent Restriction Ordinance 1959 ----S.13(2)(i)---Constitution of Pakistan (1973), Art.185(3)---Default in payment of rent---Landlord submitted that Courts below having failed to appreciate that no rent receipt was produced by tenant with regard to alleged payment of rent to landlord, it could not possibly be held that tenant was not defaulter in payment of rent and mere fact that rent was being accepted by landlord irregularly, could not absolve tenant of his default entailing his eviction under the law---Submissions raised by petitioner/landlord in support of petition deserving consideration, leave to appeal was granted.
