GHULAM DIN VS MUHAMMAD ASGHAR West Pakistan Urban Rent Restriction Ordinance 1959--2 , West Pakistan Urban Rent Restriction Ordinance 1959 Ss. 2(c)(i) & 13---Displaced Persons (Compensation and Rehabilitation) Act (XXVIII of 1958) S.30---Relationship of landlord and tenant---Respondent, claiming to be landlord, himself stated in his eviction petition filed against petitioner that petitioner/ assumed tenant, was not in possession of house in dispute either on 28-12-1958, or before that date---Respondent desirous of seeking eviction of petitioner did not claim that there existed contractual tenancy between him and petitioner/assumed tenant---Petitioner, who did not happen to be a tenant of respondent either by contract or by operation of law, was not liable to be evicted by Rent Controller, because Rent Controller exercising limited jurisdiction under Ordinance did not have power to order eviction of petitioner in circumstances.
