SHAH MUHAMMAD VS MUHAMMAD RAFIQ Constitution of Pakistan 1973--199 , S.13(6) --- Constitution of Pakistan (1973), Art.199 --- Constitutional jurisdiction exercise of --- Rent Controller's order directing deposit of rent beyond period of three years from the date of riling of rent application was defective and invalid- Courts below failing to give required attention to the real point in controversy inasmuch as neither the record was read properly nor the law applied correctly- Orders of Court, below thus suffered from want of conscious and judicious application of mind --- Constitutional petition against order of eviction was accepted and case was remanded to Rent Controller for proceeding under provisions of S.13(6) of the Ordinance in accordance with law.
