NASIR JAMAL VS ZUBEIDA BEGUM Sindh Rented Premises Ordinance 1979--15 , Sindh Rented Premises Ordinance 1979 ----Ss.15(2)(ii) & 16(1)---Default in payment of rent---Rent Controller, despite holding that landlord had failed to prove default as alleged by him in his ejectment application, ordered ejectment of tenant on ground that tenant had committed default in payment of rent in respect of period subsequent to filing of ejectment application and upto the date of passing of tentative order for payment of rent---No separate application for eviction of tenant for default in payment of rent for period subsequent to filing of ejectment application having been presented by landlord, Rent Controller, held, had acted in excess of his jurisdiction in ordering eviction of tenant on that ground.
