ABDUL MEHDI VS ABDUL HAKIM Sindh Rented Premises Ordinance 1979--15 , Sindh Rented Premises Ordinance 1979 ----S. 15---Civil Procedure Code (V of 1908), O.XLI, Rr.23 & 33---Respondent in appeal was entitled to support order of eviction passed by Rent Controller by pressing for the reversal of finding recorded on any issue against him without filing cross-objections---Provisions of O.XLI, Rr.23 and 33, C.P.C. were not applicable to proceedings in such an appeal---Notwithstanding non-applicability of provisions of riling of cross-objections, it was desirable if respondent at the first available opportunity placed on record, in any suitable manner, his intention to assail order of Rent Controller on any issue. which had been decided against him so that appellant could have a reasonable and fair opportunity to make submissions in that behalf at the regular hearing of appeal.
