PROVINCE OF PUNJAB VS KHAN MUHAMMAD Martial Law Regulation 1972 No. 118--RGLN. , West Pakistan Urban Rent Restriction Ordinance 1959--13 , ---S.13--Privately-Managed Schools and Colleges (Taking Over) Regulation, 1972 [M,L.R. 118], paras. 12, 12-A & 12-B--Taken over schools--Buildings not owned by Government--Liabilities under previous legal arrangements between school management and landlords--Where buildings were not owned by the Government in taken over schools, position of occupants would ordinarily be that of tenants-All liabilities under previous legal arrangement, before taking over of institution, were transferred to Government through their functionaries--Mere fact that any such agreement was not registered or that it was not properly stamped would be of no assistance to petitioner nor the fact that such agreement had formally expired--Leave to appeal against the order of High Court dismissing writ petition of the petitioner against its eviction, refused.
