DOST MUHAMMAD VS ABDUL RASHID West Pakistan Urban Rent Restriction Ordinance 1959--13 , ---S.13--Constitution of Pakistan (1973), Art.185(3)--Leave to Appeal was grad to examine whether refusal of Rent Controller to implead Custodian, Enemy Property, Government of Pakistan, was fatal and proceedings for eviction of tenant from rented premises were defective and no order of eviction could be passed against tenant in absence of Custodian, Enemy Property.
