HAMID KHAN VS WALI MUHAMMAD Constitution of Pakistan 1973--199 , N.-W.F.P. Tenancy Act 1950--24 , ---Ss. 2 & 24--Constitution of Pakistan (1973), Art.199-- Ejectment--Questions of ejectment and compensation for improvement had been fully dealt with by the forums of exclusive jurisdiction in competent proceedings in which tenants were found defaulters in payment of rent and the question of compensation had also been dealt with in the impugned judgment and orders--Such finding of fact based on proper appraisal of evidence was not open to interference in Constitutional jurisdiction--No bar exists, on the ejectment of a tenant-at-will either in the Tenancy Act or any other law under which exception could be taken to ejectment as ordered by competent forums--Constitutional jurisdiction was thus declined to be exercised against eviction of tenants.
