VS MUHAMMAD SIDDIQUE Cantonments Rent Restriction Act 1963--17 , Cantonments Rent Restriction Act 1963--27 , Cantonments Rent Restriction Act 1963 ---Ss.17 & 27--eviction proceedings--Procedure and powers of Rent Controller--Rent Controller though not a Court, but acting as quasi judicial Authority while deciding valuable rights of parties is obliged to apply his mind to entire evidence on record and to objectively decide various questions of law and facts arising for determination--Rent Controller cannot act whimsically, capriciously or in arbitrary manner, but was required to state the reasons which had persuaded him to arrive at a particular decision--Where Rent Controller while deciding issues like default in payment of rent and personal need not only completely ignore the evidence produced on record but dealt with such question in a cursory manner, approach of Rent Controller held was contrary to all norms of judicial procedure--Setting aside the order case was remanded to be decided afresh in accordance with law.
