KHURSHECDUL ISLAM VS QAMAR JAHAN Sindh Rented Premises Ordinance 1979--15 , Ss. 2(f)(j) & 15(2)(ii)--eviction of tenant on ground of default--Existence of relationship of landlord and tenant--Proof--Tenant admittedly, was in occupation of premises in dispute prior to its transfer to donee landlord by its original owner through valid gift--Tenant denying title of landlord in respect of premises in dispute contended that he was inducted as tenant in premises by a person other than original owner--Tenant, who had been served with requisite notice by donee landlord, held, by operation of law, had become tenant under donee landlord on same terms and conditions on which he was holding premises at time of service of notice--Fact that tenant was paying rent to unconcerned person, would not relieve him from liability as to payment of rent to donee landlord.
