RAHIMUDDIN VS MUNNY KHAN Sindh Rented Premises Ordinance 1979--15 , Sindh Rented Premises Ordinance 1979 Ss.15 a 21-.-Default in payment of rent--Proof of--Where no receipts were being issued by the landlord in acknowledgement of receipt of rent, mere word of such landlord qua the words of tenant could not be given any more weight particularly when the landlord did not make mention of that fact of default in any of the coupons of money orders sent by tenant to him which he had returned--Landlord had, therefore, no cause of action for filing eviction application on ground of default in payment of rent--Fact of refusal by landlord to accept rent remitted by tenant for specified period was not mentioned in eviction application--Rent Controller's order based on ground of default in payment of rent was not sustainable as such.
