RAFIQUNISA VS SHAHABUDDIN Sindh Rented Premises Ordinance 1979--16 , Sindh Rented Premises Ordinance 1979 ---S. 16--Striking off defence--Tentative Rent Order passed by Rent Controller not complied with by tenant and no satisfactory explanation was given for non compliance thereof--Tenant disputed rate of rent and contended that it was Rs.120 per month and not Rs., 300-Tenant claimed that his counsel appearing before Rent Controller had admitted rate of rent to be Rs.300 per month through mistake--Written statement which „vas verified on oath clearly mentioned that rate of rent was Rs.300 per month--Tenant neither deposited arrears of rent nor future rent @ Rs.300 and receipts shown by him revealing that he deposited rent at rate of Rs.120 per month-.Held, tenant failed to comply with order passed by Rent Controller which was not suffering from any infirmity--Order of eviction maintained in circumstances.
