NATIONAL BANK OF PAKISTAN VS BILQUIS BEGUM Sindh Rented Premises Ordinance 1979--15 , Sindh Rented Premises Ordinance 1979 ---S.15--Ejectment--Landlady claiming that portion of first floor of demised premises which was also occupied by, tenant was not included in tenancy agreement which was arrived between the parties and that said portion was to be surrendered by tenant to her--Subject-matter of tenancy agreement was same which was subject-matter of two previous tenancy agreements and Rent Controller had wrongly arrived at conclusion that first floor was not covered by fresh tenancy agreement--Finding of Rent Controller was contrary to factual position and record--Fresh tenancy agreement omitted to mention detail of accommodation of first floor in Schedule due to oversight or because of typing error--Application of landlady seeking eviction of appellant tenant was dismissed in circumstances.
