ABDUL SHAKOOR VS ABDUL TAHIR KHAN Sindh Rented Premises Ordinance 1979--21 , Sindh Rented Premises Ordinance 1979 S.21--Martial Law Order (Zone 'C') No. 20---Staternent under-Effect--Tenancy of rented premises between parties expired in 1978-Appellant complained to Martial Law Authorities against his eviction where he gave undertaking to vacate premises by a specified date-Landlord respondent filed eviction application before Rent Controller who allowed same on the basis of said statement of appellant--Order impugned on the ground that the undertaking was obtained through harassment and force--Such averments about the undertaking and respondent's knowledge about it also made in written statement--No evidence produced by respondent to rebut same nor specific issue was framed, held, the respondent had dropped this plea, that appellant continued tome the statutory tenant and question of termination of tenancy was to be decided under the prevailing law.
