JAMES GILL VS DURREH SHAHWAR Cantonments Rent Restriction Act 1963--17 , Cantonments Rent Restriction Act 1963 ---Ss. 17 & 24--eviction proceedings--Relationship of landlord and tenant--Tenant denying relationship of landlord and tenant between parties alleged that he himself had constructed house in dispute-Inconsistency, however, existed between his version made in that respect in his written statement and one bolstered up during evidence--Tenant conceded that he had signed compromise agreement arrived at between parties during former ejectment proceedings whereby tenant undertook to make payment of rent in time--Agreement between parties in respect of continuation of tenancy subject to payment of rent in time having been concealed by tenant and having been made part of judicial record and its copy per se being admissible, need to examine any marginal witness; thereof, held, was obviated as provisions of Evidence Act did not meticulously apply to ejectment proceedings.
