Haji ABDUL RASHEED VS FIDA HUSSAIN Sindh Rented Premises Ordinance 1979--21 , ---Ss.15 & 21--Default in payment of rent--Tenant's mother co-sharer of property in question and tenant had been paying rent to her since long--Dispute existing between her and respondent landlord and a civil suit was pending—Respondent landlord had refused to receive rent on ground that tenant's mother was maligning and disgracing him--Held since tenant's mother was co-sharer of property, entitled to receive rent and opposed ejectment application, there was no justification for Rent Controller to order ejectment of tenant--eviction order set aside.
