DILBAR HUSSAIN VS MAHMOODUL HASAN Code of Civil Procedure 1908--96 , ---Art. 185(3)--Civil Procedure Code (V of 1908), S. 96--Sale of immovable property--eviction of licensee occupant--Petitioner occupying suit property as licensee filed suit for declaration that sale of said property in favour of respondents was contrary to law and they had no legal right to evict him from suit property--Suit dismissed by Trial Court and High Court, on reappraisal of evidence, found that petitioner being a licensee and stranger to transaction in respect of property, was not entitled to challenge same when sale was supported by vendor himself--Position in law and finding of fact supported by evidence on record being unexceptionable, leave to appeal refused.
