SAKINA BIBI VS MUHAMMAD ASHRAF Cantonments Rent Restriction Act 1963--17 , Cantonments Rent Restriction Act 1963 Ss. 17 & 24--eviction of tenant--Order for--Appeal against--Rent Controller in his earlier order deciding issue of personal need against landlord, ejected tenant on ground of default in payment of rent--On appeal by tenant against ejectment order, Appellate Court on ground that case had not been properly tried, set aside order of Rent Controller in to and sent back case to Rent Controller for re-trial with direction that issue of personal need should also be decided afresh--Issue of personal need having itself been re-opened by Appellate Court, Rent Controller, on remand of case to him, held, Could decide such issue again and no legitimate exception could be taken to recording of fresh findings by him on that issue.
