Relationship of landlord and tenant--Points to be determined--Premises in possession of petitioner admittedly was portion of building which belonged to non-Muslim evacuee--Said non-Muslim evacuee disposed of entire building through several sale transactions in favour of different persons--Some of transactions were approved by Custodian but sanction to other sales was refused--Petitioner contended that premises in his possession formed part of sale which was not confirmed by Custodian and thus he was not liable to pay rent to respondent and Rent Controller failed to determine controversy in respect of transaction of premises in dispute--Case remanded with consent of parties to Rent Controller for determination of said controversy in accordance with law.
