SAFDAR AHMAD VS FARUKH NISA Sindh Rented Premises Ordinance 1979--15 , Ss. 15 (2) (ii)-Landlord and tenant-eviction on ground of default-Rent Controller could pass order of eviction if he was satisfied that tenant had failed to pay rent--There being no tenancy agreement in writing rent for January was payable within 60 days when it became due viz. by the end of March-Original tenant however died in February before rent became due-Arrears of rent prior to death of original tenant, held, could not be recovered under rent proceedings though same might be recovered under ordinary law--eviction proceeding could not be filed against appellants in respect of that debt/arrears of rent-Statutory tenants depositing rent in Court of Rent Controller within statutory period were protected against eviction.
