MUFTI VS GHULAM SARWAR DAWOODI Sindh Rented Premises Ordinance 1979--21 , Sindh Rented Premises Ordinance 1979 ---S. 21--West Pakistan Urban Rent Restriction Ordinance (VI of 1959), Ss. 12 & 13--Ejectment on ground of default--Payments made by tenant on behalf of landlord--Landlord failing to make necessary repairs-Tenant, held, to seek permission from Rent Controller to carry out repairs etc.--Tenant not seeking permission of Rent Controller for repairs etc. was not entitled to adjustment of such payments in rent and was in default in payment of rent to that extent--Such default, however, being not wilful, eviction order, could not be granted on that basis.
