BALQEES BEGUM West Pakistan Urban Rent Restriction Ordinance 1959--13 , ---S. 13-Ejectment-Landlord on purchase of property also assigned to receive arrears of rent (from year 1962) with transfer of property in his favour through registered sale-deed-Rent beyond period of three years preceding institution of ejectment petition cannot be claimed-Question of arrears of rent assigned, if can be made basis for seeking eviction of tenant, required detailed examination by Rent Controller-Dispute as to default in payment of rent to be thrashed out thoroughly after proceeding further under S. 13-Order of ejectment passed by Rent Controller and appellate Court in circumstances was violative of law-Case remanded to Rent Controller to frame issues and afford hearing to parties for decision in accordance with law.
