MUHAMMAD ASHRAF VS MUHAMMAD SAFDAR West Pakistan Urban Rent Restriction Ordinance 1959--13 , -- S. 13-eviction proceedings-Default in payment of rent-Written objections filed by tenant not showing his sending of; rent to landlord through money order - Tenant not producing receipts of Postal Authorities or returned counterfoil of money orders, neither summoning record of Postal Authorities to show that rent has actually been tendered through money order which was refused - Tenant producing only money order receipt showing sending of money order which was refused-Tenant not examining any witness or producing certificate issued by Assistant Postmaster before Rent Controller neither any other document to prove tender of rent-Tenant, held, failed to prove tender of rent of premises in dispute and as such his eviction rightly ordered by appellate Court, in circumstances.
